Hands Free and Distracted Driving Act Going Into Effect in September

Beginning September 1, 2025, the South Carolina Hands‑Free and Distracted Driving Act (H3276) makes it illegal to hold or support a phone or electronic device while your vehicle is in motion on a public road. For the first 180 days, officers will issue warnings only to help educate drivers. Starting March 1, 2026, citations will be issued.

It’s Illegal (While Driving) to: Hold or support a phone or electronic device, Read, write, or send a text, email, or message, Watch videos, video chat, livestream, or play games. You May Still: Use GPS or navigation (hands-free only), Stream audio or take calls via voice or a single tap, Use voice-to-text (no typing), Use Bluetooth, earpieces, or smartwatches. There are some exceptions like if: Your vehicle is lawfully stopped or parked (e.g., red light, traffic, or parking lot), You are reporting an emergency or hazard, You are a first responder on official duty, You are using approved work-related dispatch systems

The Penalties After Warning Period are: 1st offense: $100 fine, 2nd or more within 3 years: $200 fine + 2 license points, No arrest will occur solely for a violation (unless you fail to appear in court)
